[SCPLH] All licensed premises (other than members clubs) must have at least one personal licence holder. There must also be a premises manager who holds a personal licence.So, both of these requirements can be satisfied by the appointment of the premises manager.
However, many businesses prefer to have more than one member of staff as a personal licence holder, for example a bar supervisor.A personal licence authorises the holder to supervise or authorise the sale of alcohol. Such authorisation is a mandatory condition of the premises licence and without it an offence is committed. To apply for a personal licence you need to be 18 years old and have an accredited licensing qualification. In Scotland that is the Scottish Certificate for Personal Licence Holders [SCPLH]. The full day course includes a minmum of 6 hours training plus a 1 hour examination with multiple-choice type questions. Scottish Certificate for Personal Licence Holders (Refresher) (1/2 day) [SCPLH(R)]
The role of the personal licence holder is important in ensuring that sales of alcohol are legal. The need for a continuing competence to undertake the role is underlined by the legal requirement for refresher training.
Although a personal licence is valid for 10 years, holders must complete such refresher training within 5 years of the date of issue of that licence. They must then submit evidence of this having been done to the Licensing Board no later than 3 months beyond the end of that 5 year period. That evidence is provided by way of the Scottish Certificate for Personal Licence Holders (Refresher) qualification [ (SCPLH(R) ] The Licensing Board which granted your licence will send you a reminder about the need for refresher training at least 12 months before the end of the 5 year period. You must complete the training before the 5 year period elapses. Failure to do so and to evidence that completion to the Licensing Board will lead to the revocation of your licence. You will then have to obtain a new SCPLH qualification and re-apply for a personal licence. This half-day course involves at least 3 hours of training followed by a 1 hour examination which consists of multiple-choice style questions. So, don't delay in getting your refresher training. Mandatory Staff Training in terms of Schedule 3 of Licensing (S) Act 2005 [MST]
Any person who is involved in selling or serving alcohol must receive relevant and appropriate training before commencing employment. This does not include premises licence holders. Premises managers and other personal licence holders will already hold the SCPLH qualification.
For everyone else, however, there is a mandatory requirement to undertake at least 2 hours training which covers 16 identified topics. There is no requirement for the training to be formallly assessed, unlike the need for the examinations undertaken for the SCPLH qualifications. However, a record of the training received by staff must be made and signed by both those who receive and who deliver the training. We can provide mandatory staff training for businesses at their own premises which is particularly useful when there are a number of staff to be trained. That type of arrangement also attracts savings on standard training costs. Equally, we run courses at our training venue to which businesses can send staff, or which individuals may want to attend to obtain a training record before looking for jobs in licensed premises.
